Ruling due in suit over artillery that hit home, killed cat

Homeowners live near Picatinny Arsenal in N.J.

NEWARK, N.J. — A federal judge in New Jersey is due to rule on a lawsuit filed by a family whose home was hit by a piece of stray artillery from a nearby military installation.

The incident occurred in 2008 in Jefferson Township in Morris County, where Frederick and Cheryl Angle’s home sits near the Picatinny Arsenal.

A two-pound piece of shrapnel crashed through the roof of the home during weapons training, killing the family cat.

The Angles, who have three children, sued the government last year for negligence and emotional distress. They claim the event traumatized the family and lowered the value of their property.

The government claims the court doesn’t have jurisdiction under a provision of the law governing sovereign immunity.

A judge heard oral arguments Wednesday.
