Soldier to present insanity defense at trial

HOLLIDAYSBURG, Pa. — A troubled Iraq war veteran says he is pursuing an insanity defense against charges that he fatally shot two people while robbing a Subway sandwich shop.

Defense attorney David Shrager on Tuesday asked a judge for more time to prepare a petition to the court on behalf of Nicholas Horner, 29, of Altoona. The law requires attorneys to provide notice of an insanity defense.

Blair County District Attorney Richard Consiglio is pursuing the death penalty in the April 6 robbery of a Subway sandwich shop in Altoona. Horner allegedly killed a 19-year-old clerk and a bystander while taking about $130.

Horner was home from the Army on medical leave and his family contends his actions were fueled by post-traumatic stress disorder.
