FORT BRAGG, N.C. — Army judicial officers are reviewing evidence to decide whether the case against a Fort Bragg soldier charged in a 1985 triple slaying can continue to trial.
WRAL-TV reported Army Master Sgt. Timothy Hennis on Wednesday faces an Article 39 hearing, the military equivalent of a civilian grand jury.
Hennis is charged with killing 31-year-old Kathryn Eastburn and her two daughters at their Fayetteville home.
Hennis was convicted in state court and sentenced to die, then acquitted in a new trial ordered by an appeals court. Hennis retired from the Army in 2004, but the 51-year-old was forced back into uniform so he could be tried in military court.
Civilian authorities said DNA evidence linked Hennis to the killings.
