Pfc. Dominique Graham of the 2nd Infantry Division was given a suspended five-year sentence by a South Korean court on Wednesday for his role in smuggling approximately nine pounds of methamphetamine into South Korea, Stars and Stripes reported.

Graham had agreed to receive a package for another person through a U.S. post office. Graham's defense argued he did not know about the drugs in the package. However, judges said he previously agreed to accept packages for the man for at least $900, according to the news report.

"It would run counter to Graham's words and actions that Graham believed the post contained daily essentials," the judges said in the ruling.

They considered Graham's lack of a criminal record, his military service, his limited role in providing access to the APO box and the fact that the drugs did not make it into circulation, and decided he will not have to go to jail as long as he does not violate South Korean law during his five-year suspended sentence.

The 2nd Infantry Division's public affairs office said Graham "has been released back to his chain of command for further disposition."
