A former Fort Drum soldier was sentenced to one year and one day in prison for defrauding the IRS out of $115,000, Syracuse.com reports.

Former Sgt. Bobby Lemon filed false income tax returns for lower-ranking soldiers, claiming that the soldiers were married with children when they weren't, or that they had more children than they actually did. When the soldiers received their refunds, they would split the refunds with Lemon, according to court records.

Despite guidelines recommending a 24- to 30-month imprisonment, Lemon was sentenced to one year and a day and ordered to repay $115,391 to the IRS. His time in the military was cited by the judge for the reduced sentence.

Lemon served 17 years in the Army and was honorably discharged in 2015. He served two tours of duty in Iraq and one in Afghanistan, according to his lawyer.
